In 2003 the U.S Supreme Court found that antisodomy laws were unconstitutional in the case of Lawrence v. Texas. In its ruling, the Supreme Court held that intimate consensual sexual behavior was part of the fundamental liberties protected by substantive due process under the 14th Amendment.
